If you do not agree with the terms of this Privacy Policy, please do not use the Site.By visiting the Site or any FunnelDash client website that provides notice of its use of Funneldash and/or this policy, or registering for our service, you acknowledge that you accept and consent to the practices outlined in this Privacy Policy. We provide certain services to commercial users of our Site (each, a “Client” and collectively, “Clients”), who, in turn, may own and operate their own websites or mobile applications (“Client Site(s)”), and who wish to utilize our code, software and services and reports to analyze and obtain information regarding how third party visitors to their Client Sites (“Client Site Visitor(s)”) are interacting with their Client Sites (“Visitor Information”).Our products and services (including, without limitation, Funneldash’s AdPay, AdCapital and AdAgency services) are intended for use only by businesses, and you may only use a Funneldash Account or Card if you are an employee or other authorized representative of a business that has opened a Funneldash Account. The business’ administrator is responsible for the Funneldash Account and cards associated with that business. An administrator can: restrict, suspend, or terminate your access to or ability to use the services, access personal information about you, access or retain information stored with us, and restrict your ability to edit, restrict, modify, or delete information associated with your use of our products and services.

TYPES OF INFORMATION WE COLLECT
Funneldash may collect personal information from you including, without limitation: (a) personal information about you that can uniquely identify you, such as your name, your title / role, social security number or taxpayer ID number, address, email address, password, third-party application IDs, other identity information (such as copies of your passport, driver’s license or other national ID), and other similar information, and (b) financial and business information including bank account numbers, Employer Identification Number (EIN) and/or credit card numbers that you link to your Funneldash account or give us when you use our Services. The personal information we process depends on the products you use and how you access them. Before permitting you to use the Services, we may require you to provide additional information, including but not limited to your date of birth, social security number and other personal information. We may use this information to verify your identity or other information you provide.
When you visit the Funneldash website or use the Services, we may collect information sent to us by your computer, mobile phone or any other device. This information may include your IP address, device information including but not limited to identifier, name and type, operating system, location, mobile network information and standard web log information, such as your browser type, traffic to and from our site, the pages you accessed on our website (including referring and exist pages), and any other available information. We may also collect information about your use and interaction with our website, application or the Services. For example, we may evaluate your computer, mobile phone or other access device to identify any malicious software or activity that may affect the availability of the Services. When you use the Services, we may also store information based on your usage history. This includes, but is not limited to, details of your purchases, content you viewed, event information, click stream information, and cookies that may uniquely identify your browser or your account. We may also collect information about you from any contact you have with any of our services or employees, such as, with our customer support team, in surveys, or through interactions with our affiliates.
We may collect information about your activities including, without limitation, your transactions (including, without limitation, payment method, purchase amount, purchase date, purchase location, place of purchase, receipt information and information provided to us by the card network associated with transactions, merchants or cardholders), your marketing campaigns and use or interactions with other sites. We may also collect information about you that does not uniquely identify you. Additionally, when you access the Site using a mobile device, we may collect and process real-time information about the location of your device.
We may enable you to access social networks or other websites (collectively, “Third Party Site(s)”) through the Site. If you access any Third Party Site(s) through the Site, your use of the social network is governed by such Third Party Site(s) respective terms and conditions and privacy policies. If you access a Third Party Site through the Site, you may be asked to grant us access to certain information from your social network profile, such as your friends or contacts lists, photographs, and updates. This information may be used by us to suggest new features and content that may be relevant to you, for statistical analysis, or for other commercial purposes.
When you visit the Site and/or are a Client which utilizes Funneldash’s service, we may also collect certain information by automated means, such as cookies (which may include sending one or more cookies or anonymous identifiers to your device). “Cookies” are small files that are downloaded by a browser when a site is visited, and are returned to an originating site and/or third party site on subsequent visits. We also use cookies and anonymous identifiers when you interact with the services we offer to our partners, such as advertising services or Funneldash features that may appear on other sites and in any other manner that we deem necessary for our business purposes. We may also use third-party website analytics tools (such as Google Analytics) that collect information about user traffic on the Site. The information we may obtain or collect may include, but is not limited to, the following (collectively, “Funneldash Client Information”):
We may also obtain information about you from third parties such as credit bureaus and identity verification services. You may choose to provide us with access to certain personal information stored by third parties such as social media sites (such as Facebook and Twitter). The information we have access to varies by site and is controlled by your privacy settings on that site and your authorization. By associating an account managed by a third party with your Funneldash account and authorizing Funneldash to have access to this information, you agree that Funneldash may collect, store and use this information in accordance with this Privacy Policy.
Our Clients may use customized and proprietary Funneldash code, software and/or services (“Service(s)”) to obtain information regarding the activities that users engage in while visiting their web pages (“Client User Data”). When a user visits a website that uses Funneldash’s Service, Funneldash’s code contained on the Client website contacts Funneldash’s servers and may enable Funneldash to collect Client User Data. Some Clients may also use their own code to obtain Client User Data and then send such information to Funneldash’s servers. Client User Data may include personally identifiable information as such term is defined above.
Client User Data may be stored on Funneldash’s web servers and databases (including those hosted on third party servers on behalf of Funneldash) for use in performing analysis and producing reports for the applicable Funneldash Client. In addition, Funneldash itself may use Funneldash’s own Service in order to obtain insights into visitors’ activities on its own Site.
Funneldash’s collection and analysis of Client User Data helps our Clients to evaluate and understand how their users are interacting with their websites, and potentially, to modify their websites in order to make them more valuable or useful for their users. Funneldash’s Clients may determine the types of Client User Data that are sent to Funneldash’s servers for analysis. This data may include or be linked to depending on how the Client uses Funneldash’s Services on its website(s). Funneldash’s Clients are contractually prohibited from sending personally sensitive Client User Data (e.g. personal health information, political opinions, religious or philosophical beliefs) to Funneldash’s and Funneldash’s does not knowingly receive such data.
In addition, Funneldash may collect certain information about a Client’s visitor’s computer that may be provided by the visitor’s browser. This includes browser information, operating system information, mobile device information, IP address, time of visit, and the referring site, application, or service. Such information may be collected and shared with a Client even though not specifically requested by the Client.
In some circumstances, we require you to provide us with personal information relating to another person (such as providing us with personal information about the owners of your business during the application process or providing us with personal information about your employees). Do not provide us with any personal information unless you have obtained consent of these persons or you are sure the disclosure of the personal information is otherwise permitted by law. You must inform all other persons whose information you share with us how we process personal information and all other terms of this Privacy Policy.
Your web browser may let you choose your preference as to whether you want to allow websites to collect personal information over time about your online activities across different websites or online services. At this time our Site does not respond to the preferences you may have set in your web browser regarding the collection of your information, and our Site may continue to collect information in the manner described in this Privacy Policy.
Funneldash uses cookies on its Site. By using the Site, you accept the use of cookies in accordance herewith. You may disable use of cookies on this site through your browser settings. Cookies may serve several functions, including remembering user preferences, visited pages, time and dates, and other metrics.
Funneldash’s uses first-party cookies (small text files that Funneldash stores locally on your computer) on Client Sites for one or more of the following purposes: (i) User identification and authentication, (ii) User preference storage, (iii) A/B performance testing, and (iv) Usage pattern assessment and traffic analysis.

Visitors to the Funneldash Website. We may use the Funneldash Client Information, including personally identifiable information, for any commercial purpose, including, without limitation:
For example, we may use information to provide customer service and support, process transactions, resolve disputes, collect payments, prevent illegal activities, customize the Services, reduce risk to all parties involved in our transactions, and verify the accuracy of information. In order to provide our Services, we may share certain of your information with your payment recipient(s) including, without limitation, the payment recipient, payment method, payment amount and invoice number.
We may also use Funneldash User Information to facilitate the delivery of content, advertisements or promotional offers that we believe may be of interest to you, or to communicate with you about new or existing products and services or special offers. We may combine your information with information we collect from other companies and use it to improve and personalize the Services, content, and advertising. For more information on opting out of these communications, please see the section on “Your Choices” below.
When you choose to link your Funneldash Account with products and services provided by our business partners, we may process personal information we receive from them to ensure our products and services work properly together.
We may get information from financial service providers such as our issuing bank and our card networks to make our services work. The information may include personal information related to your transactions using a virtual or physical Funneldash Card as described above.
Visitors to the Funneldash Blog. We may use information you voluntarily provide when visiting the Funneldash blog to send you e-mail communications, such as information on upcoming webinars, and to understand how you are engaging with and perceive Funneldash’s Services.
Visitors to Funneldash’s Clients’ Websites. We may share certain information as described in the “Information We Share” section below. However, Funneldash never sells any Client User Data.
Our Client’s Use of Funneldash. Funneldash contractually requires its Clients to abide by all applicable laws, rules and regulations, including laws relating to privacy and data collection (“Applicable Privacy Laws”). Funneldash also contractually requires its Clients to obtain any necessary consents from visitors to its website(s) for the Client’s use of Funneldash’s services, comply with all Applicable Privacy Laws with respect to the transfer of personally identifiable information of EU or Swiss subjects through the Service, and to post an online privacy policy that provides each visitor with clear notice of its practices regarding data collection, use, and disclosure (including the Client’s use of Funneldash), along with a link to the Funneldash Privacy Policy.
Notwithstanding any other provision of this Privacy Policy and/or the Terms of Service, Funneldash shall not have any liability or obligation for any Client’s failure to make these disclosures on its website(s) (including, without limitation, that Client uses Funneldash’s Service) or for any Client’s use or collection of Client User Data that is not permitted under this Privacy Policy or otherwise.
Additional Uses; Aggregation of Information. In addition to any other uses described herein, we may (i) use user and transaction information for any other purpose (including internal research and/or to determine overall trends or metrics concerning how users are engaging with websites / advertisers, and may report such general trends publicly) provided that such information is aggregated in a manner such that individual user information cannot be reasonably identified, and (ii) use the information collected through cookies to identify and authenticate visitors. We may also combine the information we collect with publicly available information (including, without limitation, information from other sites including, without limitation, Google, Facebook and LinkedIn), with that of other users of the Site. For example, we may use your and other users’ non-identifiable, aggregated data to improve the services we offer, for statistical analysis, and for other business purposes.
You hereby provide us (including our vendors, suppliers, affiliates and partners) with a worldwide, perpetual, irrevocable, royalty-free right and license to use aggregated and/or anonymous data in connection with our and our vendor’s, supplier’s, affiliates and partner’s business operations including, without limitation, combining such data with other similar data from you and other users. If you wish us to refrain from providing your personally identifiable information in this manner, please see the opt-out information and contact information provided below. We also may use the information we obtain about you in other ways for which we provide specific notice at the time of collection.
We may use and disclose aggregated information about our users and their activities without restriction. We may disclose your personal information to our subsidiaries and affiliates, or to contractors, service providers, and other third parties we use to support our business, as may be further specified below.
Notwithstanding any other provision contained herein, we may partner with third parties (“Third Parties”) to offer additional products and services, including, without limitation, advertising services (collectively, “Third Party Products”). Such partners include our banking partners including Evolve Bank & Trust (“Evolve”) which enable us to offer certain banking services and products. By agreeing to our Terms of Use Privacy Policy, you also agree to Evolve’s Privacy Policy at https://www.getevolved.com/privacy-policy/. You acknowledge and agree that (i) such Third Parties may advertise such Third Party Products to you through us or via the funneldash.com website (and any other sites which have an affiliate or partner relationship with us) (collectively, the “Channel Websites”), (ii) we and Third Parties may share any information collected on Channel Websites in connection with the marketing and sale of Third Party Products, and (iii) Funneldash may receive compensation or commissions from Third Parties in connection with your use, purchase or participation in any Third Party Products. Furthermore, if you indicate that you are interested in certain advertising we may sell or license your information (including, without limitation, personally-identifiable information) to our partners (including, without limitation, lead referral partners) in order for such partners to provide such advertising and related services to you. Any information which you provide to our partners (including their respective agents, affiliates or partners) is also governed by such partners’ respective privacy policies. However, Funneldash shall have no obligation or liability in connection with your decision to use, purchase or participation in any Third Party Products (including, without limitation, participating in any compensated or non-compensated Third Party surveys or receiving any advertising services by such Third Parties) regardless of whether Funneldash receives any compensation or commissions from such Third Parties.
Service Providers. Information, including Funneldash Client Information, Client User Data, and any personally identifiable information contained therein, may be shared with employees and certain third-parties (including employees, affiliates, vendors, partners, merchant partners, marketing providers) in order to offer our Service, including, without limitation, helping facilitate technical and administrative aspects of the Funneldash Service (e.g., credit card processing), integrate our Services with our partners, facilitate the services we provide to you with our partners (including card issuing partners, credit reporting agencies, card network partners, partnership and referrals), use third-party cloud services to host our website and store the information we process about you, or perform functions related to the administration of Funneldash (e.g. hosting services). This includes, but is not limited to, processing transactions, maintaining your account, responding to court orders and legal investigations, enforcing our contractual rights, protecting the rights, privacy, safety and property of Funneldash, you, our customers, our partners or others, litigation purposes, complying with audits or other investigations, and reporting to credit bureaus. These third parties may perform tasks on our behalf and are contractually obligated not to disclose or use Funneldash User Information or Client User Data for any other purpose, and to employ adequate security measures to prevent unauthorized access to such data. However, Funneldash is not responsible in the event that personally identifiable information is disclosed at a result of a breach or security lapse by any such third party.
Law Enforcement and Legal Process. Funneldash also reserves the right to disclose any Funneldash Client Information or Client User Information (including Personally identifiable information) to: (i) comply with any applicable law, regulation, or legal request; (ii) enforce, apply, or investigate breaches of its Privacy Policy, Terms of Service or other agreements.
Funneldash Clients. Funneldash Clients may share Client User Data with service providers (e.g. customer relationship management platforms) that perform tasks on behalf of Funneldash Clients. Funneldash contractually requires the Clients to disclose such practices to its users.
Funneldash Partners. If you are a Funneldash Client that signed up through our Partner Program, your Funneldash Client Information may be shared with the Partner Program member that signed you up for Funneldash’s Service, provided that, prior to any such sharing, Funneldash will obtain contractual obligations from the Partner Program Member that it will comply with applicable laws with respect to such Funneldash Client Information. Partner Program members may use that information to help you setup, adjust, manage, and cancel your account with Funneldash. respond to client requests; and/or (iv) protect the rights, property, or safety of Funneldash, our employees and consultants, our users, or others.
With Our Merchant Partners to Provide Personalized Offers. We may share your information with merchants you interact with using Funneldash for marketing, if you consent or as permitted by law. By creating a Funneldash account, you consent to Funneldash sharing your information with merchants you use the Funneldash Services with, for those merchants to market to you. We do this to help merchants personalize services and offers, so you can have a better experience. You’re able to revoke your consent at any time by following the steps below. If you choose to do so, we will stop sharing your information with merchants from that point onward, except as necessary to complete transactions you initiate.
When Required By Law. We will share your information with any party when required by law or by a government request to do so or to combat fraud or criminal activity.
We also reserve the right to transfer your information (including, without limitation Funneldash Client Information, Client User Data and personally-identifiable information) to a buyer or other transferee in the event of a merger, divestiture, restructuring, reorganization, dissolution, sale, or other transfer of some or all of our assets.
We may sell or license your information to our (i) advertising partners, and (ii) referral partners to allow such referral partners to provide you with advertising services. Under applicable law (including the State of California), such sale or license of your information to our partners may be considered a “sale” of information. California law requires that, to the extent we sell your personal information, we maintain a separate webpage that allows you to opt out of the sale of your personal information, which can be accessed by clicking the link below: https://www.funneldash.com/do-not-sell-my-personal-information/.
If you make a purchase on the Site, we may collect additional information, including, without limitation, your credit or debit card number, expiration date, and other payment details (collectively, “Payment Information”). We may provide Payment Information and other personal information to our third party payment processors in order to complete purchases made on the Site. Pursuant to the “Information We Share” section above, our third party payment processors are bound by contractual obligations to keep such personal information confidential and use it only for the purposes for which we disclose it to them. However, we are not responsible for our third party payment processors’ use of any Payment Information or other personal information they collect in connection with your transactions on the Site.
We offer you the following choices about what information we collect from you and how we communicate with you:
Deletion or closure of a Funneldash Account. You can close your Funneldash Account at any time per the terms set out in our Terms of Service. If you are a Funneldash Account administrator, please contact Customer Service to close your Funneldash Account, otherwise please contact your business’s administrator to have your access to Funneldash Cards deleted. Closure or deletion of your Funneldash Account will mean that you permanently lose access to the Funneldash Account, personal information, and data associated with the Funneldash Account. Certain personal information or de-identified information associated with your business’s Funneldash Account may nonetheless remain on systems owned or maintained by Funneldash where required to comply with the law or our contractual obligations.
Application rejection. To comply with legal and regulatory obligations, we retain certain personal information associated with rejected applications for a Funneldash Account.
California rights. If you are a California resident, you have certain rights over the information that we have about you. Starting January 1, 2020, you can:
Access a copy of any personal information we have about you
Delete any personal information we have about you when we do not have legal or contractual obligations to keep the information
Correct any personal information we have about you either in your settings, contacting your Funneldash Account administrator, or by contacting us as provided below
Exercising your choices. To exercise your choices about your personal information, please contact our Customer Service team at 805-826-DASH during available support hours. If you are an end user of Funneldash’s services and not a direct customer of Funneldash (for example, your business uses Funneldash and you’re an employee or authorized representative of that business), you should direct requests relating to your personal information to the administrator of your business’s Funneldash Account. We will not discriminate against you for exercising any of your rights.
Electronic communications. You may choose not to receive promotional emails from us by following the unsubscribe/opt-out instructions in those emails, but we may still send you non-promotional messages relating to information about your our products and services such as updates to our platform agreement, privacy notices, security alerts, and other notices relating to your access to or use of our products and services.
Cookies. Most browsers will tell you how to stop accepting new cookies, how to be notified when you receive a new cookie, and how to disable existing cookies. Please note, however, that without cookies you may not be able to take full advantage of all of the Site’s features.
Marketing Emails. If we have sent you a marketing email, you may choose not to receive additional marketing emails from us by following the unsubscribe instructions contained in each email.
Location and Social Media Information. You may be able to restrict our collection and use of real-time information about your mobile device’s location through your device’s privacy settings. You can restrict our access to your social network profile at any time by changing your social network privacy settings.
Web Analytics. You may opt-out of the aggregation and analysis of data collected about you on our Site by our web analytics vendor by visiting https://tools.google.com/dlpage/gaoptout and downloading and installing the Google Analytics Opt-out Browser Add-on.
Notifications. If you no longer wish to receive notifications about our Services, you may change your notification preferences by emailing support@funneldash.com. Alternatively, you may be able to indicate your preference by logging into your account and adjusting your preferences or by following the directions provided with the communication. Funneldash reserves the right to close or limit access to your account should you opt out of the crucial notices that are required to perform the Funneldash Service. You are still responsible for any amounts due to Funneldash even if we close or limit access to your account.
SMS Messaging. You can opt out of receiving SMS messages by emailing support@funneldash.com or replying “STOP” to any SMS message. Alternatively, you may be able to indicate your preference by logging into your account and adjusting your preferences or by following the directions provided with the communication. Again, Funneldash reserves the right to close or limit access to your account should you opt out of the crucial notices that are required to perform the Funneldash Service. You are still responsible for any amounts due to Funneldash even if we close or limit access to your account.
Access Your Information. You can review and edit your personal information at any time by logging in to your account on the Website or by contacting us at support@funneldash.com. You can also request to close your account by contacting us at support@funneldash.com. If you close your Funneldash account, we will mark your account in our database as “Closed,” but will keep your account information in our database to comply with our legal obligations. This is necessary in order to deter fraud, by ensuring that persons who try to commit fraud will not be able to avoid detection simply by closing their account and opening a new account. If you close your account, your personally identifiable information will not be used by us for any further purposes, nor sold or shared with third parties, except as necessary to prevent fraud and assist law enforcement, as required by law or in accordance with this Privacy Policy.
Opting Out. If you wish to opt out of Funneldash collecting Visitor Information when you visit Client Sites, please see the Funneldash Opt-out instructions. Please note that if you use a different computer or Internet browser than you used when opting out of Funneldash’s Service, Funneldash will not be able to view the opt-out and will collect Visitor Information when you visit Funneldash Client Sites. In these circumstances, you will need to revisit the link above in order to reset your opt-out decision, in order for it to be effective.
You can review and change your personal information by logging into the Site and visiting your account profile page. Subject to applicable law, you may have certain additional rights to request access to and receive information about the personal information we maintain about you, update and correct inaccuracies in your personal information, and have your personal information blocked or deleted, as appropriate. We use reasonable organizational, technical and administrative measures in an effort to protect your personal information from loss, misuse, and unauthorized access, disclosure, alteration, and destruction. Please note that no electronic transmission of information can be entirely secure. We cannot guarantee that the security measures we have in place will never be defeated or fail, or that such measures will always be sufficient or effective. Any transmission of information is at your own risk. We are not responsible for circumvention of any Site privacy settings or our security measures.
Funneldash is based in and operates the Site out of the United States. We provide and direct our services only to business in the United States and for use exclusively by their employees or authorized representatives. When we obtain personal information about you, we may process such information outside of the country in which you are located, including in the United States. The countries in which we process your information may not have the same data protection laws as the country in which you are located. We will protect your information as described in this Privacy Policy.
If you ask us to delete specific personal information (see “Your Choices” above), we will honor your request unless deleting the information prevents us from billing for our products and services, calculating taxes, conducting required audits, or carrying out other legitimate business functions, or we are required by law or contractual obligation to keep that information.
The Site is not directed to, and we do not knowingly collect or solicit personal information from, children under the age of 16. If we learn we have collected or received personal information from a child under the age of 16, we will delete that information. If you believe we might have any information from or about a child under the age of 16, please contact us at support@funneldash.com.
We reserve the right to update or change this Privacy Policy at any time in our sole and absolute discretion. If we make a material change to our Privacy Policy, we will indicate on the Site that our privacy practices have changed and will provide a link to the new policy.
